What does family allowance include?
Family allowance consists of a social security benefit, guaranteed by law, to formal employees who are INSS contributors and have children under 14 years of age or disabled children of any age.
It works as a supplement to the worker's income and is added to their remuneration.
The responsibility for paying the benefit does not lie with the employing company, but with Social Security, through the National Social Security Institute (INSS).
The employer pays the salary together with the benefit and is subsequently reimbursed by the INSS.
Who is eligible to receive family allowance?
Family allowance is accessible to all formal workers, including apprentices, casual workers and domestic employees.
However, to receive the benefit, the worker must meet certain criteria, such as the age of the children, their custody and monthly income.
Can fathers and mothers receive the benefit for the same child?
Yes, if both parents have a formal job and share custody of the child, both can apply for the benefit.
However, if custody is exclusive to one of the parents, only the one who lives with the child or adolescent is entitled to the benefit.
What is the value of family allowance?
The benefit is R$59.82 per child up to 14 years of age or disabled, regardless of age. This amount is paid per child, that is, if the worker has more than one child who meets the conditions to receive the family allowance, the amount will be multiplied.
What are the conditions for receiving family allowance?
There are some essential requirements for a worker to have access to this income supplement benefit. Check out what they are!
- Age range of children: The benefit is only granted to those who have children up to 14 years of age, or disabled children of any age.
- Custody of minors: To receive family allowance, you must have custody of your children.
- Worker's monthly remuneration: The benefit is only granted to workers with a monthly salary of up to R$1,754.18.
- Vaccination card: Workers who have children up to 6 years of age must present the children's vaccination card every year in November.
- School attendance: For children between 7 and 14 years old, it is necessary to prove school attendance twice a year, in the months of May and November.
Can you receive family allowance for guardianship of a stepchild?
Yes, as long as the worker proves that the stepchild lives with him and is economically dependent on him.
When does family allowance stop being paid?
Family allowance stops being paid when a child reaches 14 years of age. However, if the worker has more than one child, the benefit continues to be paid in respect of the other children under 14 years of age.
Furthermore, the benefit may be interrupted if the rules for childhood vaccination and school attendance are not followed, or in the event of the death of the dependent.
How do I apply for family allowance?
The benefit request must be made directly to the employer, who forwards the documentation and the request to the INSS.
For casual workers, the request must be made to the union that represents the category.
Is the value of family allowance the same in 2023?
Unlike the minimum wage and other benefits, the value of family allowance generally does not change each year.
However, a government ordinance updated on January 10, 2023 adjusted the benefit to R$ 59.82.
